2. Scope & Acceptance

These Terms govern the use of this Site and all contracts, offers, and transactions concluded via the Site, email, telephone, or other communication channels operated by Bluewake Outboards.

By accessing the Site or placing an order, you acknowledge and accept these Terms.

3. Eligibility & Customer Accounts

You must be at least 18 years of age and legally capable of entering into binding contracts.

If you create an account, you are responsible for:

  • Maintaining confidentiality of login credentials

  • Ensuring all activity complies with applicable laws

  • Providing accurate and complete information

We reserve the right to refuse service, restrict access, or cancel orders in cases of fraud, abuse, policy violations, or suspicious activity.

4. Privacy & Electronic Communication

Use of the Site is subject to our Privacy Policy, which complies with the GDPR.

By using the Site, you consent to receiving electronic communications, including:

  • Order confirmations

  • Service notices

  • Legal disclosures

Marketing communications are sent only where legally permitted and may be opted out of at any time. Electronic communication satisfies legal written-notice requirements.

5. License & Site Access

We grant a limited, non-exclusive, revocable license to access and use the Site for personal or internal business purposes.

  • You are not impersonating others

You grant Bluewake Outboards a worldwide, perpetual, royalty-free, sublicensable license to use such content. We may remove or moderate content at our discretion.

8. Product Information

We aim to ensure accurate product descriptions and pricing; however:

  • Manufacturers may update specifications

  • Images may differ slightly from delivered items

  • Technical variations may occur

Material deviations are governed by applicable consumer law and our Returns & Warranty policies.

9. Ordering & Contract Formation

Orders submitted via the Site are not binding.

A binding contract exists only when:

  1. An official quotation or Proforma Invoice is issued

  2. Full payment is received

  3. Order confirmation is provided in writing

  4. Inventory is allocated

We may refuse or cancel orders due to pricing errors, stock issues, fraud, or suspicious activity.

10. Prices, VAT, Customs & Payment

All prices are stated in EUR, unless otherwise noted.

Prices generally exclude:

  • VAT

  • Shipping

  • Import duties and taxes

  • Bank transfer fees

Payment Method

✔ Bank transfer only
Orders are processed only after full funds are cleared. Any bank charges must be borne by the customer.

11. Shipping, Delivery & Risk of Loss

We ship worldwide using professional logistics partners.

Unless stated otherwise:

  • Risk transfers upon handover to the carrier

  • Customers must inspect goods upon delivery

Delays caused by customs, carriers, force majeure, or incorrect customer information are outside our control.

12. Returns, Withdrawal Rights & Special-Order Products

Most marine engines and propulsion systems are special-order items, sourced individually through authorized supplier networks.

12.1 EU Right of Withdrawal (Consumers)

EU consumers generally have a 14-day right of withdrawal, unless a legal exemption applies.

12.2 Special-Order Exemption

Pursuant to Article 16(c) of Directive 2011/83/EU, goods that are configured, reserved, or sourced specifically for a customer are excluded from withdrawal.

Once a marine engine or propulsion system is allocated or reserved, cancellation is no longer possible unless mandatory law requires otherwise.

12.3 Return Eligibility

Returns may be accepted only if:

  • An incorrect item was delivered

  • The item is defective on arrival

  • Transport damage is verified

A Return Authorization is required. Refunds are processed after inspection and approval.

13. Warranty

Products are covered exclusively by the manufacturer’s warranty.

Warranty coverage depends on:

  • Brand and model

  • Proper installation

  • Maintenance compliance

Bluewake Outboards does not provide independent warranty coverage. Manufacturer decisions are final.

14. Prohibited Use

You may not:

  • Use the Site unlawfully

  • Attempt unauthorized access

  • Scrape data

  • Interfere with Site security

  • Submit fraudulent orders

Violations may result in access restriction or legal action.

15. Disclaimer of Warranties

The Site is provided “as is” and “as available”.

We do not guarantee uninterrupted operation, error-free content, or absolute accuracy. Statutory consumer rights remain unaffected.

16. Limitation of Liability

To the extent permitted by law, liability is limited to the value of the purchased goods.

This does not exclude liability for:

  • Death or personal injury

  • Fraud or gross negligence

  • Non-waivable statutory rights

17. Indemnification (Business Customers)

Business customers agree to indemnify Bluewake Outboards against claims arising from misuse, breach of these Terms, or violation of third-party rights.

18. Online Dispute Resolution (EU)

EU consumers may access the ODR platform:

Participation in arbitration is not mandatory unless required by law.

19. Governing Law & Jurisdiction

German law applies, excluding conflict-of-law rules.

For business customers, jurisdiction is Hamburg, Germany.
Consumer statutory rights remain unaffected.

20. Updates

We may update these Terms at any time. Continued use of the Site constitutes acceptance of the current version.
